Terms and Conditions for Online Sales Services
(Vietnam Market)
IMPORTANT: PLEASE READ CAREFULLY AND FULLY UNDERSTAND THESE TERMS AND CONDITIONS ("TERMS OF USE"). THESE TERMS OF USE DESCRIBE CERTAIN RESPONSIBILITIES OF McDONALD'S AND THE PROVISIONS THAT AFFECT THE RIGHTS OF USERS.
By establishing, accessing, or using any website, mobile application, email newsletters, subscription services, and other digital assets on which these terms are posted or referenced (collectively, the "Online Services"), the User enters into a binding agreement with GOOD DAY HOSPITALITY JOINT STOCK COMPANY (hereinafter referred to as "McDonald's", "we", or "us"). The Company is headquartered at 2-6 Bis Dien Bien Phu Street, Tan Dinh Ward, Ho Chi Minh City, Vietnam.
Users are encouraged to review our Privacy Statement/Personal Data Protection Policy, which describes how we collect, use, and share information.
The Online Services are not offered or intended by us for use by any individual under 13 years of age. Users accessing the Online Services must be at least 13 years of age. If the User is between 13 and under 15 years of age (or another age as required by the law of the User's country), the User may only use and reference these terms together with their parent or legal guardian, who must understand and agree to these terms in order for the User to use the Online Services.
If the User, or the User's parent or guardian, does not agree to these terms, the User must immediately stop using the Online Services and request McDonald's to close the service account the User has created. To submit an account deletion request, the User may send an email to feedback@vn.mcd.vn, and please include the email address of the account the User wishes to delete.
Product and Service Availability. McDonald's products and services are available in many locations around the world. However, within the Online Services, certain products and services may not yet be available in all countries.
Traffic Law Compliance. Users must comply with traffic laws and related regulations whenever using the Online Services. For reasons of legal compliance and safety, Users should only use the Online Services when they are in a safe and lawful state.
Users Are Responsible for Their Own Devices and Accounts. Users are responsible for the devices, software, and services required to use the Online Services. McDonald's does not guarantee that the Online Services are fully compatible with any particular device or software. Users are also responsible for any fees, charges, taxes related to messaging and data usage that they incur when using the Online Services, including when communicating with us via messages, email, or any other method the User chooses. Users may only use the Online Services on devices they own or operate under an authorized operating system (e.g., Apple iPhone OS for Apple devices). If the User creates an online account, the User is responsible for maintaining the security of the account and all activities under that account, and should ideally only log in and use the account on devices owned and controlled by the User.
Right to Update and Terminate the Online Services. The User understands and agrees that McDonald's may (with or without notice) update, modify, and terminate the Online Services (or allow Users to log in from) any McDonald's mobile application that the User has installed on their device.
Updates to Terms. McDonald's may, at its sole discretion, update these terms at any time. In the event of any changes to these terms, we will notify Users by any means we deem reasonable, such as publishing the new terms on the Online Services. If any User does not agree with such changes, please stop using the Online Services and request McDonald's to deactivate the account the User has created. To deactivate an account, please email us at feedback@vn.mcd.vn.
Independent Businesses Own and Operate the Restaurants. While McDonald's operates and controls the Online Services, McDonald's is not responsible for the business operations of most restaurants. Instead, the restaurants are operated and managed by McDonald's licensees, and others are operated by subsidiaries of McDonald's (such licensees and subsidiaries are collectively referred to as "restaurants"). Each restaurant is independently responsible for compliance with regulations relating to the provision of products and services to Users, as well as matters related to personnel working at those restaurants. The following refers to Good Day Hospitality Joint Stock Company, headquartered at 2-6 Bis Dien Bien Phu Street, Tan Dinh Ward, Ho Chi Minh City, Vietnam.
Career Opportunities from the Online Services. McDonald's and all restaurants are equal opportunity employers committed to building a diverse workforce. The Online Services may provide links to career opportunities posted by McDonald's or the restaurants. These opportunities are available only through the restaurants (i.e., franchisees or subsidiaries) and not through McDonald's or the McDonald's Corporation. This means that the restaurant posting the job listing is solely responsible for establishing job requirements, making hiring decisions, and other employment-related decisions for its operations. Neither McDonald's nor its parent company receives copies of applications submitted to franchisee restaurants, nor controls whether applicants receive interview offers or job offers, nor manages any employment policies of any franchisee. If a User receives a job offer from any franchisee, only that franchisee — not McDonald's or McDonald's Corporation — is the User's employer.

McDonald's Privacy Statement Policy. The Privacy Statement Policy describes in detail how we collect, use, and share information, which is publicly available on the Online Services platforms. Users are encouraged to review our Data Protection Policy, which we publish from time to time.

McDonald's may use the information the User has provided to communicate with the User in accordance with McDonald's Privacy Policy.
Users have the right to choose how we communicate with them. Generally, Users can find and adjust their communication preferences in the profile section of the Online Services they are using, along with instructions on how to opt out of or change communication preferences through device settings. Additionally, within the notifications we send, there may also be an option allowing the User to opt out of further communications.
Users understand and agree that they may need to manage communication preferences separately for each communication channel. For example, if the User opts out of marketing emails, the User may still continue to receive marketing SMS messages if they had previously opted in. While we strive to provide convenient ways for Users to manage their communication preferences, Users may still need to adjust settings separately for each Online Service.
Please note that for certain account-related and transactional notifications, the only way to stop receiving them is to close the User's Online Service account. If the User receives communications from a McDonald's franchisee, the User must opt out directly with that franchisee.
When the User enrolls in any McDonald's SMS program, the User understands that these programs are governed by the specific rules and policies issued by McDonald's and/or McDonald's Franchisees from time to time.
The User understands and agrees that they will receive text messages sent from automated systems. The User also understands that consent to receive messages is not a condition for completing any purchase transaction.
If the User wishes to withdraw consent and unsubscribe from messages, please send an email to feedback@vn.mcd.com.
Submitting Orders to Restaurants. This section applies to all orders the User places through the Online Services. Please read this section carefully before submitting any orders to restaurants through the Online Services. Please note that the ordering feature may not be available on all Online Services. Please refer to the Frequently Asked Questions (FAQs) posted from time to time for more information about ordering.
About Ordering. The purpose of the ordering feature is to provide customers with a convenient method to pre-create and submit orders to participating restaurants. To place an order through the Online Services, the User must have a registered account. Required information for registration includes: last name, first name, and email address.
Registering a Payment Method. Prior to submitting an order, the User must register a credit card or debit card (collectively referred to as a "payment card") to be used for payment.
McDonald's and the restaurants use third-party service providers to securely store the User's payment card information and to process payments. The User understands and agrees that when registering a payment card, McDonald's or third parties may verify the card's validity. The User also understands and agrees that when the User uses the ordering feature to make a purchase from a restaurant, that restaurant will be the merchant of record. The restaurant may request additional information beyond the order number to verify the transaction. The User represents and warrants that the User is of legal age and has the full legal right to use the registered payment cards.
Users Purchase Products Directly from the Restaurant. When using the ordering feature, the User submits orders directly to the participating restaurant and the contract for the supply of products is established between the User and the restaurant that accepts the order. The restaurant at which the User collects the products is responsible for preparing and providing the products to the User.
Creating, Paying for, and Submitting an Order. Users may use the ordering feature to create an order and submit it to the participating restaurant of their choice. The purchase is completed and the User's payment card is charged when the User clicks "Pay Now" on the Online Services. The User will receive an order code. Orders that have been created must be collected in person at the selected restaurant.
Order Collection Options. Users may select the following online order collection methods:
Order Preparation. All products are subject to availability at the restaurant where the User collects their order. When selecting a restaurant, the User will see the serving hours for the breakfast or regular menu at that restaurant. When selecting counter or drive-thru collection, the User will see the corresponding service hours (e.g., 6:00 AM – midnight). If the User arrives after the restaurant's closing time, the User will not be able to collect the order and the payment will not be refunded. Please ensure the User can arrive on time before confirming and paying.
Counter Pickup: The User will see an estimated order preparation time. After confirmation and payment, the order will be prepared. If the User has location services enabled and is far from the restaurant, the User may be asked to confirm readiness before payment and order preparation. If location services are disabled, the order will be prepared immediately after payment. Please ensure the User can arrive on time.
Drive-Thru: The User confirms and pays in advance, but the order is only prepared when the User arrives at the drive-thru and provides the order code. If the User arrives after a menu change or if a product is no longer available, the User should communicate with staff.
Curbside or Table Service: Upon arrival, the User must enter their parking spot number or table number in the app before paying. After payment, the order will be prepared. When ready, staff will bring the order to the User.
Product Notes. Some restaurants may not carry all products. Product images and packaging on the Online Services are for illustrative purposes only and may differ from the actual product due to:
Pricing. Each restaurant independently determines its own prices and independently applies applicable local sales taxes or any fees required by law. Some promotions or prices may not apply to all orders or all locations. If the User discovers a pricing error, please contact the restaurant where the User made the purchase to request a refund of the difference.
Location Services. Users may need to enable location services on their device to:
If location services are disabled or the User does not wish to select the nearest restaurant, the User may manually select a restaurant.
Order Payment. When the User clicks "Pay Now", the User authorizes the restaurant to process the order. The restaurant's payment service provider will process the transaction and charge the User's selected card. The User may receive a notification that the restaurant has accepted the order and is preparing it. The User takes ownership of the products upon receipt.
Payment Issues or Refunds. If there are any questions about a transaction on the User's card statement or the User wishes to dispute a charge, please contact the User's bank. The bank will advise on its policies and the timing for releasing any held funds.
Fraudulent Activity. If the User suspects unauthorized transactions:

Cancellations, Refunds, and Consumer Rights
Users may modify or cancel an order at any time before confirmation and payment. After confirmation and payment, the User may not cancel the order. If a User wishes to request a refund (e.g., a product does not meet the required standards), please contact the restaurant where the purchase was made directly or report the service issue via email at feedback@vn.mcd.com. The User's statutory rights as a consumer are not affected by these terms.
General Terms. These general terms describe the MyMcDonald's Rewards program.
Eligibility and Participation. To participate in the MyMcDonald's Rewards program, Users must log in to use the Online Services. Customers who registered an account to use the Online Services before the launch of the MyMcDonald's Rewards program are eligible to participate by continuing to use the Online Services on or after the program launch date.
Offers. Users may receive our offers through the Online Services. The following general terms apply to all offers: (1) offers are only available through a specific Online Service and for the products displayed, subject to availability, and only at specific restaurants, until the offer's expiration date; (2) specific service time frames apply (e.g., some offers are only available during breakfast hours); (3) unless otherwise explicitly stated, offers will expire on the stated redemption date; (4) each offer may only be used at one restaurant; (5) offers are non-transferable; (6) offers may not be converted into cash; (7) offers may only be redeemed at restaurant payment counters, kiosk machines, or drive-thru, and may not be used for the Delivery Service. Additional specific terms may also apply to individual offers, which will be communicated to Users through the mobile application.
How to Redeem Offers. Users may redeem offers when ordering at in-store payment counters or kiosks by scanning the QR code of the offer, or at the Drive-Thru by reading the alphanumeric code to the staff member recording the User's order.
How to Earn Reward Points. Users may earn reward points based on the value of their order at a fixed rate — specifically, for every VND 1,000 (one thousand Vietnamese Dong), the User will earn 1 (one) reward point. Users may refer to the program rules posted by us on the mobile application and website.
Users may earn reward points from eligible orders at participating restaurants by placing orders via:
In cases where this process is not followed, Users will not be able to earn reward points or request retroactive point crediting. Please note that the integration of reward points into an account may be delayed due to technical issues.
Reward and Promotional Programs. From time to time, McDonald's may launch reward and points accumulation programs that allow Users to earn reward points in new ways. Any changes to the program will be communicated widely through media and other communication channels.
Maximum Reward Points Balance. The maximum reward point balance per account is 100,000 points, with a maximum of 20 orders per day for points accumulation. Once a User reaches the maximum point balance or the daily order limit, the User will not be eligible to earn points on their next order for that day. McDonald's reserves the right to change this value with or without notice to the User.
Redeeming Reward Points. Users may redeem reward points at restaurants by exchanging them for products offered free of charge on the Reward Redemption Menu ("Redeemed Products"). Users use the McDonald's app to redeem points and select a reward from the Reward Redemption Menu.
Users redeem their reward offers at the point of order:
Reward Redemption Menu. Redeemable Products and the number of reward points required to redeem them are available in the Reward Redemption Menu section of the mobile application.
Reward Points Expiry. Reward points are valid for 12 consecutive months from the date the User earns them through a transaction. Once set, reward points cannot be changed. Expiring points will be extended to the last day of the month; for example, if a customer earns points on a date other than the last day of the month — such as the 5th, 10th, or 20th of January 2020 — the reward points will expire on January 31, 2021. Users may view their transaction history in the app.
Refunds. McDonald's reserves the right to deduct reward points at any time if the User returns a product for any reason and receives a partial or full refund of the purchase price. This also applies to product exchanges, unless the exchange involves a product of equivalent reward point value.
Suspicious Activity. McDonald's reserves the right to take any action deemed appropriate, including deleting or suspending the User's account and the reward points accumulated, if we detect any suspicious activity related to the User's account, including but not limited to:
Reward points have no cash value. Reward points are non-transferable.
Each User may create only one (1) MyMcDonald's Rewards account.
Users are responsible for updating their name, email address, or other details as soon as any changes occur. McDonald's will not be held liable when the User fails to comply with this obligation.
McDonald's reserves the right to terminate the Loyalty Program if events beyond its reasonable control mean it can no longer be operated.
McDonald's reserves the right to decline to honor any Offer Voucher/Loyalty Reward Voucher or loyalty points if, in its reasonable judgment, the App, Offer Voucher/Loyalty Reward Voucher, or loyalty points have been tampered with.
An account will automatically terminate upon the death of the account holder. Points or Loyalty Vouchers earned but not yet redeemed will be cancelled. McDonald's will close the MyMcDonald's Rewards account upon notification of the account holder's death. McDonald's will not be liable for any loss or damage suffered by any person as a result of such cancellation.
McDonald's retains ownership of all materials and advertising related to the Offer Vouchers and/or Loyalty Program, together with all intellectual property rights in those materials and advertising.
Participation in the Loyalty Program constitutes acceptance of these terms and their interpretation in accordance with the laws and jurisdiction of Vietnam.
Users agree that the following activities will be deemed invalid when participating in the Loyalty Program:
Nothing in these terms shall affect Users' statutory rights. McDonald's may (at its sole discretion) refuse to participate in any claim except as otherwise provided in these terms.
All instructions, terms, and conditions on any promotional materials or advertisements relating to this Promotional Program form part of these terms. In the event of any conflict, these terms shall prevail over all other instructions, terms, and conditions.
Users may cancel their account at any time by selecting 'Delete Account' in the Profile section of the App. Upon confirmation of cancellation, all accumulated offers, reward points, and vouchers in the User's account will expire immediately. Accordingly, McDonald's recommends that members plan carefully before cancelling to avoid unintentional loss of accumulated points. Once expired, points cannot be reinstated.
Users purchase products directly from restaurants. When a User redeems offer vouchers or reward points, the User redeems them directly with a restaurant, and the contract for the supply of products is between the User and the restaurant that accepts the User's order (not with McDonald's or any other member of the McDonald's System). The restaurant at which the User collects the products is responsible for preparing and providing them to the User. McDonald's Corporation (the parent company of McDonald's), its subsidiaries, affiliates, franchisees, agents, representatives, dealers, and their officers, directors, and employees collectively constitute the "McDonald's System Members".
McDonald's Intellectual Property Rights. Any and all rights in the Online Services are and shall remain the exclusive property of McDonald's or McDonald's licensors. For clarity, "Online Services" includes any and all content on the Online Services, such as but not limited to text, images, graphics, logos, page headers, button icons, images, audio clips, digital downloads, aggregate data, software, trademarks, service marks, trade dress, brand identity, audio, video, data, and other materials (collectively, "content"), as well as any part of the Online Services. The Online Services provide a licensed — not sold or transferred — service and/or constitute any permission to use any intellectual property to Users. Nothing in these terms is intended to transfer any such rights to or vest any such rights in Users. Users may not take any action that endangers, limits, or interferes with the rights of McDonald's or McDonald's licensors.
Use of the Online Services. Subject to these terms, Users are granted a personal, non-exclusive, non-transferable, and revocable license to use the Online Services solely for the User's own personal, non-commercial purposes in accordance with these terms. For clarity, "Use" includes the right to access, interact with, and display. No license or right is granted to Users by implication or otherwise, except for the licenses and rights explicitly granted by these terms. McDonald's reserves all other rights.
Trademark Information. Trademarks, service marks, and all graphic elements, including the appearance displayed on the Online Services, are proprietary and protected trademarks or trade dress of McDonald's or its licensors. The Online Services may also contain various third-party names, trademarks, and service marks that are the property of their respective owners.
User Feedback. Certain Online Services may allow Users to submit comments, suggestions, ideas, graphics, photos, questions, complaints, or other information posted or communicated to McDonald's through the Online Services (collectively, "submissions"). The User understands that by submitting any information to McDonald's through the Online Services, the User grants McDonald's a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license to use, copy, distribute, sublicense, modify, translate, prepare derivative works of, publicly display, and publicly perform the submissions, including for any commercial or other purpose without the approval of or compensation to the User or any other person.
Unsolicited Ideas. It is McDonald's policy not to consider unsolicited ideas. While we appreciate the time Users take to think about McDonald's, we are unable to consider new ideas from outside the McDonald's system. Users expressly waive any and all claims against McDonald's and McDonald's System Members related to McDonald's review, use, or development of any products, designs, concepts, or other materials similar or identical to the User's current or future submissions. Please see McDonald's FAQs for more information.
Restrictions and Other Limitations. With respect to the Online Services (including content), Users must not:
Limitation of McDonald's Liability. McDONALD'S, ITS RESTAURANTS, OR ANY OTHER MEMBER OF THE McDONALD'S SYSTEM SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, OR BUSINESS, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES, INCLUDING LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING FROM OR OUT OF THE ONLINE SERVICES. NOTHING IN THIS SECTION IS INTENDED TO LIMIT McDONALD'S LIABILITY FOR DAMAGES ARISING FROM McDONALD'S OWN NEGLIGENCE, INTENTIONAL MISCONDUCT, OR VIOLATIONS OF LAW. ADDITIONALLY, NOTHING IN THIS SECTION IS INTENDED TO LIMIT OR ALTER USERS' RIGHTS AS CONSUMERS THAT CANNOT BE LIMITED OR ALTERED UNDER APPLICABLE LAW. McDonald's reserves all legal rights to recover damages or other remedies under these terms or as permitted by law.
McDonald's Provides the Online Services "AS-IS" Without Any Warranties. The Online Services may contain inaccuracies or errors. McDONALD'S PROVIDES THE ONLINE SERVICES "AS-IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. McDONALD'S DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. McDONALD'S DOES NOT WARRANT OR REPRESENT THAT THE ONLINE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE, THAT ERRORS WILL BE CORRECTED, OR THAT THE ONLINE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE USER ASSUMES FULL RESPONSIBILITY IN CONNECTION WITH THEIR USE OF THE ONLINE SERVICES. THE USER'S SOLE REMEDY AGAINST McDONALD'S AND ALL OTHER McDONALD'S SYSTEM MEMBERS FOR DISSATISFACTION WITH THE ONLINE SERVICES IS TO STOP USING THEM. THIS LIMITATION OF REMEDIES IS PART OF THE AGREEMENT BETWEEN THE PARTIES.
Third-Party Services. The Online Services may link to or allow Users to use third-party websites, downloadable materials, content, social media, or other digital services (collectively, "third-party services"). These third parties may have their own terms and conditions or privacy policies that Users should review and understand before using them. McDonald's does not endorse and is not affiliated with any such third-party services. McDONALD'S AND ALL OTHER McDONALD'S SYSTEM MEMBERS ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE ARISING FROM OR IN CONNECTION WITH THESE THIRD-PARTY SERVICES.
Events Beyond Our Control. McDONALD'S AND OTHER McDONALD'S SYSTEM MEMBERS ARE NOT RESPONSIBLE FOR McDONALD'S FAILURE TO PERFORM ANY OF ITS OBLIGATIONS UNDER THESE TERMS DUE TO OR ARISING FROM ANY EVENT BEYOND McDONALD'S REASONABLE CONTROL. If such an event occurs, McDonald's obligations under these terms will be suspended for the duration of the event; and McDonald's may, but is not required to, make reasonable efforts to find a solution by which its obligations may be performed notwithstanding the event.
Dispute Resolution. Users agree that any claim or dispute (whether in contract, tort, or otherwise) the User may have with McDonald's arising from or relating to the Online Services or these terms shall be resolved exclusively by final and binding judgment of a court of competent jurisdiction in Vietnam.
These terms incorporate and supplement the terms and conditions of Apple, Inc. ("Apple") (available at http://www.apple.com/legal/itunes/us/terms.html#service), including the End User Licensed Application terms contained therein ("Apple Terms"). If the User is accessing the Online Services through an Apple application ("Apple App"), the User also acknowledges and agrees that:
If the Apple App the User has downloaded does not conform to any applicable warranty for that App, the User may notify Apple, and Apple may refund the purchase price of the Apple App to the User subject to Apple's then-current terms and conditions. To the maximum extent permitted by law, Apple makes no other warranty, condition, or other term with respect to the Apple App and will have no liability to the User for any claims, losses, costs, or expenses of any nature relating to the Apple App or arising from the User's or any other person's use of the Apple App or reliance on any content therein.
McDonald's makes no representation that the Online Services are appropriate or available outside of VIETNAM. If Users access the Online Services from other locations, they are responsible for compliance with applicable local laws.
These terms shall be governed by and construed in accordance with the laws of VIETNAM, notwithstanding any conflict of laws principles. Users irrevocably consent to the exclusive jurisdiction of the courts in VIETNAM for the purposes of any legal action arising from or relating to these terms or the Online Services.
Although these terms govern the Online Services as between McDonald's and Users (and although Apple is not a party to these terms, nor are any other McDonald's System Members parties to these terms), Apple and other McDonald's System Members are third-party beneficiaries under these terms and shall have the right to enforce against Users those rights that McDonald's holds under these terms to the extent such terms may relate to them; there are no other third-party beneficiaries under these terms.
These terms are written in Vietnamese. Any translation of these terms into another language is provided solely for the User's convenience and reference, and in the event of any conflict between the two versions, the Vietnamese version shall prevail.
Upon termination of these terms or upon the User's cessation of use of the Online Services, all rights granted to the User under these terms shall terminate; however, these terms shall continue to apply to the User's use of the Online Services and anything relating to or arising from such use prior to termination. After termination, all of McDonald's and other McDonald's System Members' rights, including all intellectual property rights, ownership rights, and licenses under these terms shall survive, as shall all usage restrictions, all limitations of liability and disclaimers, and all other related provisions.
Each of the terms and conditions herein is severable and operates independently. If any one of them is unlawful, void, or unenforceable, the remaining terms and conditions shall remain in full force and effect.
If McDonald's has not required the User to fulfill any of the User's obligations under these terms, or if McDonald's has not enforced its rights against the User, or delays in doing so, that does not mean McDonald's has waived its rights against the User, nor does it mean the User is not required to comply with those obligations.
McDonald's may transfer its rights and obligations under these terms to another organization or entity, but this will not affect the User's rights or our obligations under these terms. Users may only transfer their rights or obligations under these terms to another person with McDonald's written consent.
